Last updated: September 20261. مقدمة وقبول الشروط1. Introduction and acceptance
تحكم شروط الخدمة هذه استخدامك لمنصة UM Track ("المنصة" أو "الخدمة"). باستخدامك للمنصة أو إنشائك لحساب فيها، فإنك تقر بأنك قرأت هذه الشروط وفهمتها ووافقت على الالتزام بها. إذا كنت لا توافق على أي جزء منها، يرجى عدم استخدام المنصة.These terms of service govern your use of the UM Track platform (the "Platform" or "Service"). By using the Platform or creating an account on it, you acknowledge that you have read and understood these terms and agree to be bound by them. If you do not agree with any part of them, please do not use the Platform.
2. مزوّد الخدمة2. Service provider
تُقدَّم المنصة من قبل Umrah Track، ومقرها مدينة جدة، المملكة العربية السعودية. يُشار إليها في هذه الوثيقة بـ«نحن» أو «UM Track».The Platform is provided by Umrah Track, based in Jeddah, Saudi Arabia. It is referred to in this document as "we" or "UM Track."
3. إنشاء الحساب والأهلية3. Account creation and eligibility
لاستخدام المنصة، يجب أن تكون ممثلًا مخوّلًا لجهة عمل مشروعة (شركة أو مؤسسة عمرة، أو جهة مرتبطة بتنظيم رحلات العمرة)، وأن تقدّم معلومات دقيقة عند التسجيل. أنت مسؤول عن الحفاظ على سرية بيانات الدخول الخاصة بحسابك، وعن جميع الأنشطة التي تتم من خلاله.To use the Platform, you must be an authorized representative of a legitimate business (an Umrah company or office, or an entity involved in organizing Umrah trips), and provide accurate information when registering. You are responsible for keeping your account credentials confidential and for all activity that occurs through your account.
4. الاستخدام المصرح به4. Permitted use
يجب استخدام المنصة فقط للأغراض المشروعة المتعلقة بإدارة ومتابعة مجموعات ورحلات العمرة. يُحظر على وجه الخصوص:The Platform must only be used for legitimate purposes related to managing and tracking Umrah groups and trips. In particular, it is prohibited to:
- استخدام المنصة لأي غرض غير قانوني أو مخالف للأنظمة المعمول بها في المملكة.Use the Platform for any unlawful purpose or in violation of applicable regulations in the Kingdom.
- محاولة الوصول غير المصرح به لأنظمتنا أو بيانات مستخدمين آخرين.Attempt unauthorized access to our systems or other users' data.
- إعادة بيع أو ترخيص الوصول إلى المنصة لطرف ثالث دون إذن كتابي منا.Resell or license access to the Platform to a third party without our written permission.
- إدخال بيانات شخصية تخص أفرادًا دون وجود أساس نظامي كافٍ لمعالجتها.Enter personal data about individuals without a sufficient legal basis for processing it.
5. الاشتراك والدفع5. Subscription and payment
تُحدَّد تفاصيل الاشتراك (الخطة، عدد المستخدمين، الرسوم) بالتواصل المباشر مع فريقنا، كما هو موضح في صفحة الأسعار. قد تُحدَّث الأسعار من وقت لآخر، وسيتم إشعارك بأي تغيير يؤثر على اشتراكك الحالي قبل سريانه.Subscription details (plan, number of users, fees) are set through direct contact with our team, as described on the pricing page. Prices may be updated from time to time, and you will be notified of any change affecting your current subscription before it takes effect.
6. توفر الخدمة6. Service availability
نبذل جهدًا تجاريًا معقولًا لإبقاء المنصة متاحة وتعمل بشكل صحيح، لكننا لا نضمن توفرًا مستمرًا دون انقطاع. قد تتأثر الخدمة بأعمال صيانة مجدولة، أو ظروف تقنية خارجة عن إرادتنا، أو بتوفر الأنظمة الخارجية التي تعتمد عليها بعض وظائف المنصة.We make reasonable commercial efforts to keep the Platform available and functioning properly, but we do not guarantee continuous, uninterrupted availability. The Service may be affected by scheduled maintenance, technical circumstances beyond our control, or the availability of external systems that some Platform functions depend on.
7. التكامل مع أطراف ثالثة واعتمادية نُسك7. Third-party integration and reliance on Nusuk
تدعم المنصة مزامنة بيانات الرحلات مع منصة نُسك التابعة لوزارة الحج والعمرة. هذا التكامل يعتمد على توفر واجهات نُسك واستقرارها، وهي أنظمة لا نملكها ولا نتحكم بها. لا نضمن استمرارية أو دقة أو توقيت البيانات الواردة من نُسك أو أي طرف ثالث آخر، وأي تغيير أو انقطاع في تلك الأنظمة قد يؤثر على وظائف المزامنة داخل UM Track دون أن يكون ذلك تحت سيطرتنا.The Platform supports syncing trip data with the Nusuk platform operated by the Ministry of Hajj and Umrah. This integration depends on the availability and stability of Nusuk's interfaces, which are systems we do not own or control. We do not guarantee the continuity, accuracy, or timeliness of data received from Nusuk or any other third party, and any change or disruption in those systems may affect sync functions within UM Track without this being under our control.
8. عدم الانتساب لوزارة الحج والعمرة أو نُسك8. No affiliation with the Ministry of Hajj and Umrah or Nusuk
UM Track منتج مستقل غير تابع لوزارة الحج والعمرة، وغير تابع أو مُرخَّص أو معتمَد من منصة نُسك، ولا يمثّل أيًا منهما رسميًا. الإشارة إلى «نُسك» أو «وزارة الحج والعمرة» في هذه المنصة أو في موقعنا التسويقي غرضها وصف التكامل التقني فقط، ولا تعني وجود شراكة أو تفويض رسمي، ما لم يُذكر خلاف ذلك صراحة.UM Track is an independent product, not affiliated with the Ministry of Hajj and Umrah, and not affiliated with, licensed by, or accredited by the Nusuk platform, and does not officially represent either of them. References to "Nusuk" or "the Ministry of Hajj and Umrah" on this Platform or our marketing site are solely to describe the technical integration, and do not imply any partnership or official authorization unless explicitly stated otherwise.
9. الملكية الفكرية9. Intellectual property
جميع الحقوق المتعلقة بالمنصة، بما في ذلك التصميم والشيفرة البرمجية والعلامة التجارية «UM Track»، مملوكة لنا أو مرخَّصة لنا. لا يمنحك استخدامك للمنصة أي حق ملكية عليها. تبقى البيانات التشغيلية التي تُدخلها (مثل بيانات المجموعات والرحلات) ملكًا لك أو لجهتك.All rights related to the Platform, including its design, code, and the "UM Track" trademark, are owned by or licensed to us. Your use of the Platform does not grant you any ownership right over it. The operational data you enter (such as group and trip data) remains the property of you or your organization.
10. الدعم الفني10. Technical support
نوفّر دعمًا فنيًا عبر القنوات الموضحة في صفحة التواصل. قد يختلف نطاق ومستوى الدعم حسب خطة الاشتراك.We provide technical support through the channels described on our contact page. The scope and level of support may vary depending on your subscription plan.
11. تعليق الخدمة وإنهاؤها11. Suspension and termination
يحق لنا تعليق أو إنهاء وصولك إلى المنصة في حال الإخلال الجوهري بهذه الشروط، أو الاشتباه في استخدام ضار أو غير مصرح به، مع إشعارك عند الإمكان. يمكنك أيضًا إنهاء اشتراكك في أي وقت بالتواصل معنا.We reserve the right to suspend or terminate your access to the Platform in the event of a material breach of these terms, or suspected harmful or unauthorized use, notifying you where possible. You may also end your subscription at any time by contacting us.
12. التعامل مع البيانات12. Data handling
نتعامل مع البيانات الشخصية والتشغيلية التي تُدخل إلى المنصة وفق سياسة الخصوصية، والتي تُعد جزءًا لا يتجزأ من هذه الشروط.We handle the personal and operational data entered into the Platform in accordance with our privacy policy, which forms an integral part of these terms.
13. حدود المسؤولية13. Limitation of liability
تُقدَّم المنصة «كما هي»، دون ضمانات من أي نوع، صريحة أو ضمنية. إلى أقصى حد يسمح به النظام، لا نتحمل المسؤولية عن أي أضرار غير مباشرة أو تبعية أو خسارة بيانات ناتجة عن استخدام المنصة أو عدم القدرة على استخدامها، بما في ذلك الأضرار الناتجة عن انقطاع أو تأخر بيانات واردة من نُسك أو أي طرف ثالث آخر.The Platform is provided "as is," without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any indirect or consequential damages, or data loss, arising from use of the Platform or inability to use it, including damages resulting from interruption or delay of data received from Nusuk or any other third party.
14. التعديلات على الشروط14. Changes to these terms
قد نُحدّث هذه الشروط من وقت لآخر. سنشعرك بأي تغييرات جوهرية عبر المنصة أو عبر البريد الإلكتروني المسجل لدينا، ويُعد استمرارك في استخدام المنصة بعد سريان التعديلات موافقة عليها.We may update these terms from time to time. We will notify you of any material changes through the Platform or via the email address registered with us, and your continued use of the Platform after the changes take effect constitutes your agreement to them.
15. القانون الحاكم وتسوية النزاعات15. Governing law and dispute resolution
تخضع هذه الشروط وتُفسَّر وفقًا للأنظمة المعمول بها في المملكة العربية السعودية. يُسعى لحل أي نزاع ينشأ عن استخدام المنصة وديًا أولًا، وإلا فتكون الجهة المختصة بالنظر فيه المحاكم المختصة في مدينة جدة، المملكة العربية السعودية.These terms are governed by and construed in accordance with the regulations applicable in Saudi Arabia. Any dispute arising from use of the Platform will first be sought to be resolved amicably; failing that, the competent courts in the city of Jeddah, Saudi Arabia shall have jurisdiction.
